General Conditions of Sale by Public Auction
The Sale is made in cash and the purchasers will pay in addition to the bids, per lot and without degressivity the following expenses:
30% VAT included for Voluntary Catalogued and Specialty Sales, 26% VAT included for Voluntary Period and Style Sales. The fees for wine lots are 20 % exclusive of tax.
The applicable VAT rate is 20% except for books 5.5%, the VAT on the fees can be refunded after communication of any proof and this within a maximum period of one month.
Payment must be made immediately after the sale exclusively by bank transfer or credit card depending on the amounts and the country of origin of the card. Cash payments are limited according to the regulations in force.
Cheques are not accepted.
The highest and last bidder will be the buyer subject to the auctioneer accepting the last bid and declaring the lot awarded.
The buyer will become the owner of the auctioned property only after the effective payment. The tolerance of a storage does not engage the responsibility of the Auction House, the object being considered under the exclusive guarantee of the buyer as soon as the adjudication is pronounced.
In the event of a double bid recognized by the auctioneer and noted in the minutes, the item will be put up for sale, all the amateurs present and on the phone being able to participate in this second auction.
The withdrawal of the objects can be deferred until the collection and certified payment. If you are an online bidder, you authorize the auctioneer to use your credit card information to proceed with the payment, partial or total, of your purchases including the costs to be paid by the buyer. Estimates made before the sale are provided for information purposes only.
The export or import of cultural goods may be subject to authorizations, which will be the exclusive responsibility of the buyer. The Auction House can assist the buyer in the realization of the procedures.
The lack of authorization or its delay will not justify a request for cancellation of the sale.
Similarly, restrictions on the export of certain species are the sole responsibility of the future buyer.
Special conditions of sale are applicable to the sale of specialties and can be consulted on request.
CONDITION OF THE LOTS
All lots are sold under the guarantee of the auctioneer and, if necessary, of the expert who assists him, according to the designations given in the catalog and taking into account the rectifications announced at the time of the presentation of the lot and recorded in the sale report.
As these are antique and/or second-hand items, only the most important accidents are mentioned in the descriptions.
The indications given by the auction house on the existence of a restoration or an accident affecting the lot are expressed to facilitate its inspection by the potential buyer but remain subject to his personal appreciation.
Re-coating, parquetry or lining is a conservative measure and not a defect and is not mentioned.
The dimensions are given as an indication.
The absence of an indication of a restoration, an accident or an incident does not exclude in any way that a good is free of any present, past or repair defect. Conversely, the mention of a defect does not imply the absence of another defect. In any case, the objects are sold "as is" with their imperfections and defects and no cancellation of the sale will be possible with regard to restorations and small accidents as well as on the grounds of a condition not in conformity with the description.
Potential buyers are therefore invited to examine the lots that may interest them before the sale and in particular during public exhibitions and to check whether each item corresponds to the description.
For remote buyers, and in particular live buyers, the Auction House is at the disposal of future bidders to provide them with condition reports on the lots and additional photographs.
The request for condition reports is compulsory for buyers who do not visit the public exhibition and examine the objects in person. Without a formal request for condition reports, no claim for cancellation or compensation will be possible with the auction house, especially if the lot is described as sold as is.
The Auctioneers and the Experts will execute free of charge the purchase orders entrusted to them, in particular by amateurs unable to attend the sale. Purchase orders must be sent 24 hours in advance to be validated, provided that they are accompanied by all financial guarantees and communication of identity documents.
The request for a telephone line will be possible only from a certain amount decided by the auction house and according to the type of sale.
SHIPMENT OF LOTS
As soon as the adjudication is pronounced, the buyer is the full owner of his lot.
The delivery of the adjudicated objects is carried out on the place of the sale after complete payment by the successful bidder.
The Auction House can organize the transport under the full responsibility of the buyer.
